Terms of Service

These terms govern your use of Charm (the "Service") — apps and related services that let you share photos with friends and family and display them on watch faces, widgets, and phones. By creating an account or using the Service you agree to these terms. If you are under 18, you may only use the Service with the consent of a parent or guardian.

Your account

You sign in with your phone number. Keep your device secure: you are responsible for activity on your account, and should tell us promptly at help@charm.watch if you believe someone else has access to it. You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. You must give accurate information when creating your account.

Your content

Photos and messages you send remain yours. By sending them you grant us the limited, non-exclusive license needed to store, resize, and deliver them to the friends you choose, and to display them within the Service. This license exists only to operate the Service and ends when you delete the content or your account. You can delete your photos, or your whole account, at any time in the app — deletion removes your photos from our servers and your friends' devices.

You are responsible for the content you send. Only send content you have the right to share.

Acceptable use

Don't use the Service to share content that is illegal, that you don't have the right to share, or that harasses or harms others. Don't attempt to access other users' data, interfere with the Service, probe or breach its security, scrape it, or reverse engineer it except where the law permits. Don't use the Service for commercial purposes — it is for personal use. Recipients can report photos; we may remove content or suspend accounts that break these rules.

Subscriptions and billing

Parts of the Service are offered as a paid subscription (currently "Charm Gold"), billed monthly or yearly through your app store account (Apple's App Store or Google Play). Subscriptions renew automatically until cancelled. You can cancel any time in your app store's subscription settings; cancellation takes effect at the end of the current billing period, and already-paid periods are not refunded except where the law requires. Prices may change; if a price rises for a subscription you already have, you will be notified through your app store before it applies. Purchases, billing and refunds are handled by the app stores under their terms.

Copyright complaints

If you believe content on the Service infringes your copyright, email help@charm.watch with the details required for a notice under applicable law (identification of the work, the infringing material, and your contact information). We remove infringing content and may terminate the accounts of repeat infringers.

Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these terms, if required by law, or if we discontinue the Service. Where reasonable, we will give you notice. Sections of these terms that by their nature should survive termination (including Your content licensing during any wind-down, disclaimers, liability limits, and indemnity) survive it.

The Service

We work hard to keep the Service running but provide it "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We may change, suspend, or discontinue features at any time. Watch faces, widgets and delivery depend on your devices, their operating systems and your network, which we don't control.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. To the same extent, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and USD 100. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you; nothing in these terms limits liability that cannot be limited by law.

Indemnity

To the extent permitted by law, you agree to indemnify us against claims, damages and reasonable costs arising from content you send, your use of the Service, or your breach of these terms.

App store terms

The apps are distributed through Apple's App Store and Google Play, whose own terms also apply to your download. Apple and Google are not parties to these terms, are not responsible for the Service or its content, and have no obligation to provide support or handle claims relating to it — that responsibility is ours. Apple and its subsidiaries are third-party beneficiaries of these terms for apps obtained from the App Store and may enforce them against you.

Changes to these terms

We may update these terms. For material changes we will give you reasonable advance notice — in the app or at the address on your account — before they take effect. Continuing to use the Service after that means you accept the updated terms; if you don't, stop using the Service and delete your account.
